Digitization Requests - Conditions of Use

1. I/We agree to use the images requested only once and for the purpose listed in the "Statement of Intended Use" portion of this form. Any subsequent or different use (including subsequent editions, book club editions, paperback editions, different languages, etc.) constitutes a reuse and must be applied for in writing. A reuse fee wiII be charged.
2. I/We agree not to permit others to reproduce the photographic copy or digital file or any facsimile of it.
3. I/We agree to credit properly. The following is the basic credit line: L. Tom Perry Special Collections, Harold B. Lee Library, Brigham Young University, Provo, Utah. When provided, the negative numbers and the photographer's name must also be included in the credit line. Please credit as specified:
(a.) With printed matter, it is preferred that the credit line appear on the same or facing page as the illustration.
(b.) With films and filmstrips, include the credit with the other "Sources of Illustrations." In manuals that accompany filmstrips, credit at the point where the illustration is discussed.
(c.) With exhibits, credit within exhibition area.
4. I/We agree to furnish for L. Tom Perry Special Collections' permanent files, copies of any published work in which the photographic copy appears.
5. I/We agree to indicate in the accompanying caption or label any and all changes that we have made to the original photographic copy or digital file, such as taking a detail, superimposing tinting, cropping, etc.
6. I/W e agree not to reproduce the photographic copy as a dust jacket, an end paper, or to use it in any advertisement or any commercial use of a similar nature, nor to mass reproduce as unbound material unless specifically authorized by a "Letter of Permission."
7. In authorizing the publication of a photographic copy, the L. Tom Perry Special Collections of Brigham Young University does not surrender its own right to publish it or to grant permission for others to do so.
8. The L. Tom Perry Special Collections reserves the right to limit the number of photographic copies; to restrict the use of reproduction of rare or valuable material; to make special quotations on material involving unusual difficulty in copying; and to charge a higher copying fee than specified. Copies are not supplied to picture agencies except by special arrangement.
9. Any exceptions or additions to the above conditions will appear on, and be considered part of, the letter-agreement.
10. Brigham Young University can claim only physical ownership of the image(s) described on this form. It is impossible for us to determine fully or completely the identity of possible claimants of copyright. The responsibility for identifying and satisfying copyright claims must be assumed by the user/publisher.
Copyrighted material will ordinarily not be copied without the signed authorization of the copyright holder. Applicants assume all responsibility for questions of copyright and invasion of privacy that may arise in copying and in the use made of the photographic copy.
NOTICE: The copyright law of the United States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries & archives are authorized to furnish a copy of other reproductions. One of these specified conditions is that the "photocopy or Reproduction is not to be used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order, if, in its judgment, fulfillment of the order would involve violation of the copyright law.
